Gibraltar Category 2 Residency: Requirements and Benefits

By Phil Cartwright April 2026 Updated September 2026

What Is Category 2?

Category 2 is a Gibraltar personal-tax certificate, not an immigration permit. The Finance Centre Director issues certificates under the Qualifying (Category 2) Individuals Rules 2004. Residence permission and any tax residence in another country must be assessed separately.

Eligibility and Qualifying Criteria

The Rules require approved Gibraltar accommodation for the applicant's exclusive use and give the Finance Centre Director a decision on substantial and sound financial standing, good character and Gibraltar's reputation. Under rule 5, the Director may permit local trade or employment where it benefits Gibraltar's economic development; it is not an absolute prohibition. Check the current Rules, rr.3–7.

Separately, the Government announced on 18 June 2026 that it would raise its minimum net-wealth criterion for new applicants from £2 million to £5 million and grandfather existing certificate holders. This is published policy, not a numerical threshold inserted into the Category 2 Rules by LN 2026/127. Confirm the Finance Centre's current evidence requirements before applying.

Approved Residential Property Requirement

Approved accommodation in Gibraltar must be available for the applicant's exclusive use; a suitable lease may satisfy the condition without a purchase. Confirm that the proposed property and timing meet the Finance Centre Director's requirements before committing to it.

Tax Treatment and the Annual Cap

Rule 9(4) applies income-tax rates to the first £118,000 of taxable income, subject to rule 10, and sets a £37,000 minimum for a full later year. Under rule 10(1)–(2), specified foreign dividends, pensions and emoluments of office are excluded unless the holder elects to include them. Rule 10(3)–(6) separately addresses income from Gibraltar real property and income from permitted local trade or employment. There is no universal maximum tax liability for every Category 2 holder; seek individual tax advice on the income sources involved (Category 2 Rules, rr.9–10).

Legal Notice 2026/127 came into force on publication on 22 June 2026 and increased the non-refundable application fee from £1,233 to £5,000. It did not amend the wealth criterion or residence rights. Rule 8 separately requires an advance tax payment; confirm the amount with the Finance Centre.

Application Process

Applicants prepare evidence of identity, financial standing and approved accommodation for consideration by the Finance Centre Director. Any proposed Gibraltar activity should be raised under rule 5, and any immigration permission should be planned separately. The Rules describe issue, continuing conditions and certificate endorsement, rather than a universal annual renewal.

Timeline and Practical Considerations

Processing time depends on the evidence and the authorities' assessment; do not rely on an advertised fixed approval period. Category 2 status does not itself settle UK or other foreign tax residence, and the Government's 2026 announcement should not be mistaken for an automatic change to an existing immigration permission.

Benefits and Limits

The regime offers a defined calculation for certain personal income, subject to its minimum tax and separate treatment of Gibraltar-source property or permitted-activity income. It is not a blanket exemption from tax, nor does it replace separate legal, tax and immigration advice. Resilience can assist with administration; legal advice is provided by a separately instructed law firm.

Cat 2 vs Other Gibraltar Routes

HEPSS is a different specialist-employment tax certificate, while ordinary immigration residence follows its own rules. A Category 2 certificate does not grant a residence permit. Compare the conditions for the actual individual rather than treating the routes as interchangeable.
